Posting an image to the internet DOES NOT CANCEL ANY COPYRIGHT LAWS PERTAINING TO THAT IMAGE!!!!!!!
You can simply report the unauthorized use of the image to eBay.
Without a watermartk it may be more effort to legally prove the image belongs to you (although a HiRes version in your posession would be enough) but the image is still yours no matter where you post it... unless you are posting it somewhere where the host requires you to give up any legal copyright and you willingly do so... but then you are generally transferring the copyrights to the host and people using the image without permission are breaking the host's copyright protection.

Actually, Daj has a point. Once you post something on the internet, it is up for grabs because it's that accessible. There is very little that prohibits one from stealing a photo and other material online. Sure it's illegal and all that but not very enforceable at this point in time.
